Mubarak v Mubarik—the appeal

The Representation of Aaliya Mubarak [2008] JCA 196

This was an appeal against the decision of the Royal Court to revoke a variation made by a husband to exclude his wife from a family trust. It provides a helpful analysis of the scope of the Court's powers and discretions under Article 47 of the Law and supports the prevailing view that these are, in theory and in practice, actually very wide.
