Enforcement of foreign judgments in Liechtenstein

Helene Rebholz*

Foreign judgments are regularly unenforceable in Liechtenstein. Though Liechtenstein law offers a few routes to finally recover what a Liechtenstein debtor owes, the effort to enforce a foreign judgment in Liechtenstein often leads to an entirely new procedure on the merits in Liechtenstein. In order to optimize the chances of having a judgment enforced, compliance with specific formalities required by Liechtenstein law for contractual jurisdiction clauses should not be omitted, by which clauses the Liechtenstein party submits to foreign jurisdiction. Compliance in this field may turn out to be a decisive advantage in future enforcement efforts.
